Further to the TT Talk article this year 'In defence of a storm claim', here is an update from the National Oceanic and Atmospheric Administration (NOAA).
Using the appropriate modal regulations or convention, the shipper/consignor is responsible for correctly classifying any item that is to be transported. In many instances, reliance has to be placed on the manufacturer to provide reliable data so that the carrier is adequately alerted and may respond appropriately in an emergency.
Litigation can throw up complex issues - here considering whether time bars apply to misdelivery claims and the impact of commencing proceedings contrary to exclusive jurisdiction provisions.
